Request of Special Consideration For Claudia Nunez
We the undersigned petition for the consideration of the case of Claudia Nunez. Mrs. Nunez is a mother of two small U.S. Citizen children, and wife to an immigrant here legallyClaudia Nunez came to the United States on a tourist visa from El Salvador in July of 2001. Since that time, the situation in El Salvador has become increasingly dangerous for returning immigrants. According to multipleaccounts The Mara Salvatrucha (MS-13), are beating, raping, and in some case murdering El Salvadorans who have been deported from the United States. The Mara Salvatrucha formed in the United States and now has multiple murderous cells in El Salvador. Because of the potential threat to Mrs. Nunez (she has no family or support system in that country), and her family that would follow her to El Salvador, we request that the case of Claudia Nunez be placed in deferred action and/or administratively closed until such time as the situation in El Salvador improves, or Mrs. Nunez has the ability to petition for legal immigration status. As you are aware, El Salvador is still a listed country under the Temporary Protected Status Program and is a country unable to handle the return of its own citizens. Should the Notice to Appear not have been filed when you receive this, we request that you cancel the NTA. Should the NTA be filed with the Immigration Court when you receive this, we request that you move to dismiss the NTA, or join in a motion to terminate the proceedings with her attorney for approval with the immigration judge. If she has already been removed when you consider this petition, we request an agency stay of deportation. Claudia Nunez is not a violent criminal, she is simply a mother who is trying to raise her daughters and live in peace. Mrs. Nunez was arrested for driving without a licenseand because she tried to do the right thing and appear in Davidson County Tennessee court, she is now faced with deportation. The Davidson County Sheriff Department has been approved for the ICE 287(g) program but the ICE hold and issuance of the NTA placed on Mrs. Nunez falls outside of both the Sheriff and ICE stated goals of removing unwanted criminals. We the undersigned simply ask that you take into consideration the extraordinary circumstances and humanitarian concerns surrounding her case. In our estimation this case represents a low enforcement priority to ICE as well as the 287(g) program here in Nashville. Please allow Mrs. Nunez\'s two daughters (ages 3 & 4), who are American citizens, to grow up with their mother in this, their birth country.
