Complete and retroactive repeal of House Bill 3202 / Chapter 896 Civil Remedial Fees in the State of Virginia and refund of fees already collected. __________________________________ RE: Virginia \'Abusive Driver Fees\' or \'Civil Remedial Fees\' for traffic tickets: This is a petition to demand the Virginia Legislature enact a complete and immediate repeal of the State of Virginia HB3202 AKA \"Abusive Driver Fees\" or \"Civil Remedial Fees\" that became effective on July 1, 2007. We ask that: 1. The repeal be fully retroactive to July 1, 2007 2. That any fees collected be refunded to the effected drivers within 30 days 3. Any licenses suspended because of these fees be reinstated effective immediately 4. That the suspension be expunged from the records of the effected drivers 5. That insurance carriers be required to reinstate auto insurance coverage for any driver that lost their coverage due to the suspension on their driving record that was due to the fees AND/OR any increase in auto insurance premiums related to the above mentioned suspensions be rescinded and the paid increased premium amounts be refunded to the affected drivers. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ The "Civil Remedial Fees" that became effective on 07/01/2007 are an onerous and outrageous burden on the citizens of Virginia. They place an unconstitutional and disproportionate punishment of residents of the the State of Virginia for traffic violations. The exorbitant fees can place catastrophic financial burdens on hardworking citizens and their families. There is no legal basis for these fees to be implemented, and is just another way of unfairly taxing the citizens of Virginia, since these new "CRF\'s" will only be applied to Virginia drivers and not to drivers from other states convicted of traffic violations in the state of Virginia. This legislation needs to be repealed, COMPLETELY, IMMEDIATELY and RETROACTIVELY. Anything less than full repeal is unacceptable to the citizens of the State of Virginia. So a listed $300 CRF is really a $900 CRF - on a $35 traffic ticket! So the CRF is 26 TIMES the amount of the traffic fine. Tickets from other states will still collect CRF\'s from you for 3 years for the points you accumulate for out of state tickets as well as in state tickets. An annual $100 per year fee for 3 years, + $100 per point per year for 3 years. ______________________________________ Judges are not allowed to reduce or waive these fees for any reason. If these onerous fees are not paid, you will have your license suspended. If your license is suspended - You will have an extremely hard time finding any type of affordable (and required) car insurance. The financial burdens will mushroom and hit the financially weakest the hardest. With one of the highest costs of living in the US, these additional fees will only add to the financial burdens upon the citizens of the Commonwealth of Virginia.
