Deny Conditional Use Permit Application to Develop Mobile Home Park
Mr. Philip Haynie III has submitted an application to the Northumberland County Office and Building and Zoning for a Conditional Use Permit to develop a Trailer Court/Housing Development (Application 23-CU-004) on Whays Creek Road. The proposed project would use a tract of land zoned R-2, Residential Waterfront. Developing a Trailer Court/Housing Development is not a Permitted use in an R-2 zone and would require the issuance of a Conditional Use Permit to proceed.
Conditional Use permit requests can be approved, denied, or approved with conditions by the county. County regulations list possible conditions that would be considered if a conditional use permit is issued.
Other communities in Virginia are more direct in specifying the conditions that must be met in order to issue a conditional use permit. Newport News requires that the following conditions must be met:
- That the specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity;
- That adequate utilities, access roads, drainage and other necessary supporting facilities have been or will be provided;
- That the design, location, and arrangement of all driveways and parking spaces provide for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments;
- That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise, and vibration;
- That directional lighting is provided so as not to disturb or adversely affect neighboring properties;
- That there are sufficient landscaping and screening to insure harmony and compatibility with adjacent property;
- That the proposed use is in accordance with the comprehensive plan.
The signatures to this petition are county residents and property owners whose property is in the immediate vicinity of the proposed project. These property owners have significant concerns and objections to Mr. Haynie's application and want the Board to DENY the application.
Concerns and objections we have include, but are not limited to, the following:
- Project is incompatible with and injurious to the use and enjoyment of their property;
- Project will significantly diminish or impair property values;
- Application provides no information about how adequate utilities, access roads, or storm water drainage would be met;
- Storm water runoff impact to Whays Creek, Warehouse Creek, and the Great Wicomico River.
- Whays Creek Road is a narrow county road used routinely by walkers, joggers, and cyclists. Increased traffic will increase the danger to pedestrians using Whays Creek Road.
- Dirt or gravel roads within the project will greatly increase dust and road noise.
- Mr. Haynie is advertising that residents of the Trailer Park will have access to the Great Wicominco River via Inland Harbour. Mr. Haynie does not own property in Inland Harbour, and this promise would be injurious to the use and enjoyment of property owners in Inland Harbour.
