Whereas, the proposed SCS Carbon Transport LLC (“Summit Carbon Solutions”) carbon dioxide pipeline (“pipeline) is projected to be built in Burleigh County within one-and-a-half miles of the City of Bismarck’s extraterritorial area;

Whereas, the proposed pipeline placement area in Burleigh County adjacent to the City of Bismarck is currently a rural residential area with increasing density;

Whereas, the proposed pipeline placement area adjacent to the City of Bismarck is within the expected growth area of the City of Bismarck during the expected operational life span of the pipeline;

Whereas, the health, safety, property values, and property rights of residents of Burleigh County will be negatively impacted by the known and unknown risks associated with the placement of this pipeline;

NOW THEREFORE, We the undersigned request that the various governmental and regulatory entities listed above take the following actions to represent the health, safety, and property rights concerns of current and future residents, property owners, and developers:

● Oppose efforts to build ANY CO2 pipeline within twenty-miles of the City of Bismarck extra-territorial area in any direction,

● Require financial indemnification during the operational life of any CO2 pipeline for any and all injuries or loss of human life, as well as for injuries and negative impacts to livestock or agricultural productivity, arising out of or related to any accident, act, or omission that causes a CO2 pipeline release,

● Require pipeline operators to fairly compensate political subdivisions and taxpayer funded entities for any and all emergency training, equipment, and upkeep of equipment and personnel that may reasonably be necessary in order to respond to an emergency related to a CO2 pipeline release incident,

● Create a rapid-response plan utilizing first responders, local and regional law enforcement, the N.D. National Guard, and the N.D. Department of Emergency Services to educate and inform citizens on what to do in a CO2 release or other emergency, to respond to any CO2 release emergency, and to rapidly evacuate citizens (including those who may become stranded in homes, businesses, or in motor vehicles) along the pipeline route area if an accident should occur.
