The Allen Hotel is located less than 200 ft from The Church of Grace to Fujianese New York (133 Allen Street). A primarily Fujianese-Chinese Protestant Church serving in the Lower East Side since 1988. With around 500 members in the Chinese Congregation and an English Ministry (50 members and growing) serving the 2nd and 3rd generation of Chinese immigrant families. The Alcoholic Beverage Control Law prohibits certain licenses from being issued if the location of the establishment is on the same street and within 200 ft of a building that is used exclusively as a school, church, synagogue or other place of worship.

We, your constituents, submit this petition in support of a variance to New York State's 200-foot rule for Allen Hotel (Allen Street Hospitality LLC) at 140 Allen Street under the following terms:

• Rooftop Bar Exterior (Orchard & Allen Exposure): 12AM Closure, No Speakers, No Bar, No Live Music, No DJs, No TVs, No Hosted/Promoted Events, Hangar Doors Closes at 10PM (of if DJ or amplified music emanating from interior), 44 Seats
• Rooftop Bar Interior (17th Floor): 2AM Closure, 1 Bar, No Live Music, DJs Permitted 3x Month Entertainment & Ambient Level, 1 TV (no sporting events), No Hosted/Promoted Events, Hangar Doors Closes at 10PM (of if DJ or amplified music emanating from interior), 39 Seats (incl bar stools)
• Ground Floor(140 Allen) Hotel Restaurant (140 Allen): Sun - Wed 12:00:00 AM Thurs - Sat 2:00 AM Closure, 1 Bar, No Live Music, No DJs (private events only not open to public), 1 TV (no sporting events), No Hosted/Promoted Events, Hangar Doors Closes at 10PM, Sidewalk Cafe with 20 Seats (btw Delancey and Rivington) closes at 10PM, 82 Seats (incl bar stools)
• Ground Floor Hotel Cafe (Orchard Entrance): Sun - Wed 12:00:00 AM Thurs - Sat 2:00 AM Closure, No Bar, No Live Music, No DJs (private events only not open to public), 1 TV (no sporting events), No Hosted/Promoted Events, Hangar Doors Closes at 9PM, No Sidewalk Cafe, 58 Seats
• Ground Floor Bistro (79 Rivington St Entrance): Sun - Wed 12:00:00 AM Thurs - Sat 2:00 AM Closure, 1 Bar, No Live Music, No DJs (private events only not open to public), 1 TV (no sporting events), No Hosted/Promoted Events, Fixed facade, No Sidewalk Cafe, 84 Seats (incl bar stools)
• 2nd Floor Terrace (Rivington): Auxiliary space for hotel guests only, not open to the public. No Bar or Food & Beverage Permitted, No Speakers, No Live Music, No DJs; 40 Seats, Hours of Operation 7AM - 7PM
• Courtyard (Rivington) aka Entry Terrace: Limited space for public; No Bar, No Live Music, No DJs, No TV, No Speakers, No Hosted/Promoted Events, Add Acoustical Canopy & Sound Baffling (this courtyard is an entry / exit point to the terrace and is open in back facing Orchard & Allen; Not enclosed on all 4 sides), 20 Seats, Hours of Operation 7AM - 7PM
• Exposed staircase to terrace and open court yard must be have the same hours of 2nd floor terrace and Courtyard 7AM - 7PM
• No Party Buses, No Pub Crawls, No Unlimited Drink Specials, No Outside Promoters or Promoted Events
• Deliveries and sanitation carting restricted to non-sleeping hours

We oppose a legislative variance to 200 Ft Rule if these terms are not agreed in full.
