Amend City of Knoxville Ordinance 19-062 (No Masks - Street Performers)
Recently, several street performers received warnings/citations ($114.50) while on Market Square in Knoxville, TN. In an obscure, city ordinance (19-062), it states the following: (a) No person shall appear or enter, upon any street or on any sidewalk, road, public way or other thoroughfare within the city, upon any public place, or upon the property of another, wearing a mask, hood or other device which conceals his identity; nor shall any such person demand entrance or admission to or enter upon the premises or into the enclosure or house or other building of any other person while wearing a mask, hood or other device or means of disguise which conceals his identity; nor shall any person, while wearing a mask, hood or other device or disguise which conceals his identity, participate in any meeting or demonstration upon private property of another, unless written permission of the owner or occupant of such property has been first obtained, (b) If any person wearing a mask, hood or other device or disguise which conceals his identity shall enter upon the premises of another, or demand entrance or admission to the enclosure, house or other building of any resident or citizen of the city, it shall be considered prima facie evidence that such person's intent is to commit a misdemeanor. (c) Any person advising or inciting others or conspiring with others to commit an offense described in subsection (a) or (b) of this section shall be guilty of a misdemeanor. (Code 1962, §§ 28-308—28-310). This ordinance is by selective means, and is not always enforced. We, the undersigned, petition our local, governing body to amend this ordinance so that street performers who use masks as a form of art while exercising their freedom of speech/expression, as is protected in the Constitution of the United States and by the Supremacy Clause - [This Constitution, and the Laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the constitution or laws of any state to the contrary notwithstanding.], are no longer singled out, harassed, or given citations.
