In Many States,and Provences throughout Canada And the US

Child Protective Services agencies will only hold onto abuse allegation records, which may contain evidence of abuse, for about 4 -5 years. This is a violation of the child's civil rights, as they have a right to a fair trial when they reach the age of 18 that they would need those records for to have a fair trial, which is the law, and their right. This Petition is to ensure that child abuse allegation records are not discarded after any amount of time until 5 years after the alleged abused minor turns 18, in order to give them fair time to file a civil rights lawsuit if they wish, so their right to a fair trial is protected. This is about protecting the abused, not the alleged abusers. Sign the petition if you wish for the state to enact a statute in regard to this. Thank you.



The heartbreaking reality of this isn't just the violations of rights its a violation of a person's privacy and clearly not humanity cps is only holding abuse records then the records that show progress and reports on overall success are not kept or the reports explaining if the allegations were false claims bogus evidence is not kept placing families and there children at risk in many area also for deformation of character



for example what if your friend calls said cps took my kids and you knew shes innocent but cps when back 4 years to previous reports even if it was false claims they don't have the information to confirm any longer so the allegation from now and the ones from 4 years ago is used in court and judgements of parenting and safety this would be devastating because it means parents have 4 y of abuse going against them and any caseworker would be successful in getting sole permanent removal gardianship and children would not see parents again likely over some false claims

1# were is the family preservation here this is one of the major reasons child walfare was built / created for its in the legislation goverment regulations and code for good ethics they are supposed to preserve families but out of 100 each year only 4 families total will actually be preserve , reunited so that means 90 families are separated the preservation of families , numbers are lower then the separation numbers of family involved with the system definitely clear to many including Aboriginal communities and professionals, parents the system is in trouble and needs fixing and has for a long time problem is its too late at this point the system needs more then a few bandages and fixing it will lower risk mildly but it will not fix the issue permanently just like residential schools and day programs cps has become pretty close to the replacement of residencial Indian schools and programs why ? may be the greatest problem within the child welfare system and its similarities to Canadian and US residentail goverment schools and day school programs Indigenous children’s overrepresentation in the child welfare system stems from a history of colonial, the forcible removals and loss of family connection long term and policies set by the Canadian and US government and the

National Children's Bureau For much of human history, children were often seen as commodities to be bought, sold or even put to death. They were owned absolutely by their fathers.Provincial governments provided institutions like jails, reformatories and industrial schools, and support to orphanages run by churches and private organizations. They also established a system of indenture whereby a child could be assigned to an employer in exchange for room and board (and sometimes wages). At that time most people in Canada lived on farms and family survival relied heavily on the work of children.



Child labouras a social problem is associated with the rise of industrialism and capitalism. Canada was predominantly agricultural until well into the 20th century, meaning child labour did not become as serious a problem there as it did in Europe.



After 1951, the Indian Act of 1867 was repealed and replaced with a modernized version which no longer made it mandatory for Indigenous children to attend schools. However, the last residential school did not close until1996.The Indian residential schools in Canada were predominately funded and operated by the Government and Roman Catholic, Anglican, Methodist, Presbyterian and United churches. To a lesser scale, some Indian residential schools were funded by provincial governments or by the various religious orders



Although there will always be some children and families who require the services of child protection agencies, there is general acceptance of the idea that a society that provides opportunities for meaningful employment, adequate housing, universally available education and health care, and good child care for working parents will experience fewer child welfare problems




Child welfare in Canada and the United State's a system of children's aid societies established byprovincialandterritorial governments, at times in partnership with private organizations,and federal government agencies to provide services that supplement or substitute for parental care and supervision the idea was to reform residential schools and replace themwith a system that would protect children and support family preservation and provide services that would prevent issues like abuse and trauma in bio homes making the need for interventional services less likely and ultimately lowering removals Rates and lower the need for intervention service and less likely abuse causes would occur and to reform laws on mandatory programs that would forcibly removal children many of them Indigenous children and children of cultural backgrounds at first children aid seem to be a good thing in the months following the closer of residentail goverment programs mandatory schools.



Residential schools were responsible for and did children suffer?



1# These schools were run by the government with the intent ofstripping Indigenous culture, language and tradition from the children, and were also places of abuse. Most First Nations, Métis and Inuit children attended day schools located on reserves or nearby off reserve.



2# At the “schools,” which were more akin to prisons,children were stripped of their languages and cultures. Thousands of children experienced physical and sexual violence.The schools are often referred to as a place of institutionalized pedophilia. A majority of the children were also beaten and tormented. Some beaten and strapped or tied and shackled to their beds. Needles piercing their tongues or electric shocks were also a recurring punishment for speaking their native language

Today years after the closure of residential school and Day programs parents, professionals and researchers, many others are pointing out similar issues happening within the Child walfare system preservation is rare and children and families are still robbed of the rights to family connection,safety and forced adoption removal still exists within it walls when children become permanent wards they are often raised in homes that of not of the same cultures and the existence of loss of cultures and family traditions, languages are commonly known and research shows that not only does the child protection agencies remove much of the same access to cultures and traditions but studies have shown that the same abuse still exists within residential groups homes and foster home placement programs and trauma, psychological impact is widely become recognized within CPS and the broken system that desperately needs to be address the same way as residentail schools fixing it at this point isn't a option because the damage within is exceeded the chances of fixing the issues because the issues at this point would be permanent and even if the goverment attempted to address the issues it would only be fix temporarily cps is out of control and needs to be reformed and rebuild from the ground up maybe the 3rd time around the goverment will actually create more positive and impactful approaches that supports family connection and possibly making it mandatory for caseworkers to work in the home rather then removal children should never be removed from there family on hearsay and false reporting if there isn't criminal evidence and children in many cases are bagging to go home 4 years later you would think that the government would see the facts that children who are abuse always have some clear indication when around there abuser and would simply not be bagging to return to that parent it only shows that children voices are unnoticed not relied on the judge and justice system hears only one side that is the side and voice of child walfare parents rarely are allowed to speak in court and judgements are made without evidence based Information implying that there is unfair practices and injust and when a child is removed wrongfully there is no 3rd party that investigates to insure that there was factual basis or that there is concrete evidence that indicates charges child abuse is a crime if cps really had the proof that abuse has occurred then why are law enforcement not investigating weres the charges to back up these permanent and unnecessary removals ? People who have knowledge of a crime report it and we have to ask our self why there are no consequences or accountability, precautions for child protection workers or placements staff and foster parents when abuse occurs globally within there walls the justice system would be shocked if he new the actual rate of fatailties, abuse,explanation, deaths that have occurred with goverment placements and cps systems its without a doubt devastating and because its clear to researchers that the rate of incidents, fatalities is much less in natural homes then in govermental placements on a scale of 1- 10 3% of fatailties occurred in biological homes and 7% in child protection agencies placements
