با سلام و احترام

همانطور که استحضار دارید، مسایل حوزه معلولان متنوع، متعدد و مختلف است. اقدامات خوبی در دو دهه گذشته در این زمینه در دنیا و در ایران (البته با تاخیر و تقصیر) صورت گرفته است.

کنوانسیون بین المللی حقوق افراد دارای معلولیت تدوین، منتشر و در ایران پذیرفته شده است.

قانون بازنشستگی معلولان تصویب و آیین نامه آن نوشته و ابلاغ شده است.

قانون جامع حمایت از حقوق معلولان به تصویب رسید و به صورت ناقص و با اختیارات کمتر اجرا شد.

لایحه جدید برای حمایت از حقوق معلولان تدوین و ارائه شد که در فرایند تصویب قرار دارد.

مفاهیم و اصطلاحات این حوزه در سطح گسترده ای از سازمانها و نهادها و در اذهان قشرهای مختلف جامعه منتشر و رسوخ پیدا کرده است.

با همه اینها، به لحاظ تاخیر در اقدامات فوق و عدم توجه شایسته رسانه ای و نهادی، و وسعت این حوزه و شاملیت آن بر انواع معلولیتها، جانبازان، کهنسالان، مادران و... اثر بخشی این اقدامات به حد شایسته مشهود نبوده و از سوی ذینفعان احساس نشده است.

از سوی دیگر به دلایل مختلف از جمله محدودیتهای مالی و فزونی تقاضا، و فشار تورم و افزایش قیمتها، تخصیص بهینه منابع صورت نگرفته و افراد نیازمند و مبتلابه، همچنان در گیر و دار مشکلات بوده و گشایش محسوسی در روند زندگی آنها مشاهده نمی شود. هر چند که سازمان بهزیستی و سایر نهادهای مرتبط با تلاش و جدیدت بیشتری نسبت به گذشته در این خصوص همت گماشته و عملکرد بهتری ارائه داده اند.

علاوه بر جمیع مشکلاتی که جامعه معلولان ایران با آن مواجه هستند، زنان نسبت به مردان و سایر گروهها با مشکلات بیشتری دست در گریبان بوده و انگاره های فرهنگی و تبعیضهای هرچند ناخواسته جنسیتی بر مصائب آنها افزوده است.

لذا ما جمعی از معلولان با درک عمیق مسایل این حوزه و دستگاههای متولی و منابع و ... با تمام توان در پی همفکری و کمک به بررسی، تصمیم سازی و حل مشکلات هستیم و اعتقاد راسخ داریم که این همه مقدور نخواهد بود مگر با آگاهی و اتخاذ روشهای منطقی، اصولی و قانونی برای طرح و پیگیری مطالبات حوزه معلولان .

بدیهی است که هر گونه اقدام سازمانی و هزینه کرد، مبتنی بر جواز قانونی است. «لایحه جدید برای حمایت از حقوق معلولان» تدوین و در سال 1394 به مجلس شورای اسلامی ارائه شد و پس از طی مراحلی، از شورای نگهبان برگشت داده شد و در فرایند جدید بررسی و تصویب در مجلس شورای اسلامی قرار گرفت.

تاخیر در تصویب این لایحه و به تبع آن عدم پیش بینی اعتبارات در بودجه سالیانه، معیشت و زندگی معلولان را با مشکلات عدیده و دشواری مواجه کرده و سازمانها و دستگاههای مرتبط و پاسخگو را عاجز و ناتوان از ارائه خدمات می نماید.

توجه ویژه دست اندرکاران این امر بخصوص نمایندگان محترم مجلس شورای اسلامی می تواند در گشودن این گره و حل معضلات آن نقش بسیار مهمی ایفا نماید.

به همین منظور «کمپین سراسری پیگیری تصویب لایحه حمایت از حقوق معلولان» تشکیل شده است تا با همفکری، هماهنگی و اطلاع رسانی و پیگیری، همه معلولان، مسئولان، دستگاههای مرتبط، خیرین، علاقمندان و همه اقشارجامعه به تصویب سریعتر این لایحه کمک نمایند.

لذا از جنابعالی استدعا دارد با توجه به توان و نقش خود ما را در این امر مهم یاری و پشتیبانی فرمایید.

Follow-up Campaign Endorses the Comprehensive Bill of Rights of the Disabled

As you know, the issues of the disabled field are diverse, numerous and varied. Good actions have been taken in the past two decades in the world and in Iran (but with delay and fault).

The International Convention on the Rights of the Disabled is drafted, published and approved in Iran.

The Retirement Law of the Disabled has been approved and the Code has been notified.

The comprehensive law on the protection of the rights of the disabled was passed and implemented in incomplete ways with fewer powers.

A new bill for the protection of the rights of the disabled has been drafted and submitted in the process of approval.

The concepts and terminology of this field have spread to a wide range of organizations and institutions and in the minds of various sections of society.

However, due to the delay in the above measures, the lack of media and institutional attention, and the extent of this area, and its disability, veterans, elderly, mothers, etc., the effectiveness of these measures is not well-recognized and the interested people are not felt.

On the other hand, due to various reasons, such as financial constraints and increased demand, and inflation and rising prices, there has been no optimal allocation of resources, and those in need and affairs are still busy and there is no significant opening up of their lives. However, the Welfare Organization and other institutions associated with more recent efforts have made it more effective in this regard.

In addition to all the problems faced by the disabled people in Iran, women have faced more problems than men and other groups, and the cultural and gender-based stereotypes of gender-based discrimination have increased their suffering.

Therefore, we, a group of people with disabilities, with a deep understanding of the issues in this area and the custodianship and resources, and ... with all our might, are seeking help and understanding, decision-making and problem-solving, and we have a firm belief that this will not be possible except through awareness and the adoption of rational, principled and legal methods for designing and pursuing disability claims.

Obviously, any organizational and costly activity is based on a legal license. A new bill for the protection of the rights of the disabled was drafted and submitted to the Islamic Consultative Assembly in 1394, after which he returned from the Guardian Council and was re-examined and approved by the Islamic Consultative Assembly in a new process.

The delay in approving the bill and, consequently, the unpredictability of credits in the annual budget, make it very difficult for people with disabilities to live, and the organizations that are associated and responsive are unable to provide services.

Special attention of the practitioners of this matter, in particular, the honorable representatives of the Islamic Consultative Assembly, can play a very important role in opening this node and solving its problems.

To this end, the "Widespread Campaign for Tracking the Adoption of the Bill on the Protection of the Rights of the Disabled" is set up to help speed up the adoption of the bill, with the cooperation, coordination and information and follow-up of all people with disabilities, officials, affiliated organizations, charities, enthusiasts and all sectors of society.
