
Empowering the CNMI Courts to require the CNMI Government to right their wrongs


REFERENDUM PETITION REJECTING 1 CMC §7207 AND THEREBY EMPOWERING THE COURTS OF THE COMMONWEALTH TO REQUIRE THE GOVERNMENT TO BE RESPONSIBLE FOR THE ADJUDICATED UNJUST WRONGS AND INJURIES IT HAS COMMITTED
WHEREAS, although our Commonwealth Courts have determined that our Government has unjustly wronged and injured our people and is therefore liable, judgments entered by our Courts have remained unpaid because the Government has been shielded from judicial enforcement by 1 CMC § 7207;
WHEREAS our Legislature has not appropriated, and neither has our Governor requested funds to be appropriated for the payment of many judgments in spite of such knowledge of these judgments;
WHEREAS, some of these judgments have more than quadrupled because the interests are accruing at the rate of more than $3,000 daily; and
WHEREAS, some of the wronged and injured victims have died without ever being compensated;
NOW, THEREFORE, WE, the people, respectfully reject by referendum 1 CMC §7207, that reads as follows:
Except for funds appropriated for settlements and awards, no court may require the disbursement of funds from the Commonwealth Treasury or order the reprogramming of funds in order to provide for such disbursement. Any final judgment of a court shall be paid only pursuant to an item or appropriations for settlements and awards.
FURTHER, WE PETITION that this referendum rejecting and repealing 1 CMC §7207, quoted in full above, be placed on the ballot of the next general election.
