This matter is urgent. The State of Kansas and Johnson County are incorrectly defining our boutique fitness studios as large-scale gyms, excluding us from the Phase 1 Reopening set to be determined tomorrow, April 30, 2020. There are a variety of problems with this determination. Most importantly, it is not our responsibility to prove that we cannot reopen safely. It is the state that has to prove that we cannot open safely. This may need to be determined in the U.S. District Court. It is our hope that the State of Kansas and Johnson County will see that they have NOT given deference to the business owners, like us, and individuals with respect to our fundamental civil rights. This is required by the U.S. Constitution and upheld by the Supreme Court.

We are prepared to open safely on May 4, 2020. Social distancing requirements will be met and exceeded. Sanitation requirements will be exceeded on a patron per space utilized basis. Limitations for patronage admittance will be based upon limited occupancy per square foot of floor space. This formula would be no more than 1 person per 150 square feet of floor space. Classes will staggered so that patrons can come and leave without interaction or contact of the next small group or class. Between the staggering, staff will clean and disinfect each space for a minimum of 10 minutes to eliminate possible contagions. This exceeds most standards currently in place with "essential' businesses allowed to operate.
