Opposition to the Ngatiwai
Trust Board Deed of Mandate
We the
undersigned DO NOT SUPPORT the
Ngatiwai Trust Board Deed of Mandate.
The Deed of Mandate has fundamental flaws in that it still fails to
allow whanau hapu
claimants with affiliations to Ngatiwai to prosecute their claims in the
Waitangi Tribunal Stage
Two Hearings - taking place right now.
The Deed of
Mandate does not support hapu mana and rangatiratanga as guaranteed in He
Whakaputanga me Te Tiriti o Waitangi. That the Ngatiwai Trust
Board has no PSGE models or structures included in the Deed of Mandate. This direct
negotiation process will potentially undermine the current Waitangi Tribunal
Stage 2 Hearing process which is underway.
WE DO SUPPORT the following:
1. The claimants
rights to prosecute their claims before the Waitangi Tribunal in the WAI 1040
Te Paparahi o Te Raki Inquiry.
2. That a Report
and findings from the Waitangi Tribunal is essential for progressing Ngatiwai
Wai claims.
3. That at the
completion of the Waitangi Tribunal process that Wai Claimants then can decide
on a Negotiation and settlement process that best reflects the collective
desires and aspirations of Wai Claimants and whanau, hapu.
