we actually did it and council officially backed down on the property standards changes. honestly im stunned but so glad that they finally listened to what we were asking for. we need to stay sharp just in case but for now lets celebrate this win.

From the April 17th meeting of council a motion was passed for council to revisit the Property Standards By-Law, with what we believed would be the intent to make amendments that would suit the interests of the residents.

With this in mind, we are making the following requests of council and staff to adequately meet our concerns and expectations:

  • ALL complaints to the Property Standards officer MUST be written complaints, made on the form as provided by the Township. These documents must be kept by the municipality for a duration of at least 10 years. If demanded by the property owner, proof of this complaint must be provided. If the township is concerned with retaliatory efforts against the complainant, then a redacted copy of the form or other similar proof must be made available.
  • Under no circumstances, save and except for circumstances of grave emergency, will the Property Standards officer enter upon any property without first obtaining consent from the owner or obtaining a warrant granting access. If a filed complaint is not obvious to passerby or the complainant without trespassing upon the property, no measures shall be taken.
  • In the event that consent is not granted and access to the Property was assumed under the guise of emergency concerns, and it is deemed that no emergency issue was present at the time of entry, NO order, evidence or measures undertaken shall stand.
  • All Biosecurity requirements of any farm property will be adhered to, at all times. This includes all posted signs, verbal and/or written instructions. This shall apply to all lands within the township.

If its late at night and people come on to your property how do you know if its a cop or a criminal? You dont so right there thats dangerous for the officer and the home owner. Plus if there is a need for a search there should be no problem getting a warrent.

I do not feel it is necessary to enter a privately owned property unless there is a complaint. Also if the by law office gets hurt while on my property without my permission who is liable?

I have seen an employee of the township, enter the back yard of a property, and I am quite sure that he did not have the permission. I have also had the same employee enter my house without knocking out ringing the door bell.

George and I are residents of Mornington. We live on line 80. This Property Standards Officer should never have been able to be installed. No one has the right to enter our property without just cause. If the O.P.P. can not enter , then this person sure does not have a reason. I worry about the Bio Security being threatened.

I am a Broiler Chick Hatching Egg Producer and biosecurity is one of my biigest concerns. We only have 1 flock per year so can't risk anyone coming at their own choice.

South Easthope Ward. This is a blatant disregard of my property rights. When a Bi-law officer has more authority then a police officer to come on to my property and enter buildings “WITHOUT A WARRENT!!” will not tolerate this from our elected council!!!!
