PETITION FOR THE IMMEDIATE HANDOVER OF THE MANAGEMENT OF RESIDENSI HARMONI 2 BY HARMONI PROPERTIES SDN BHD

WE THE UNDERSIGNED, HEREBY PETITION Harmoni Properties Sdn Bhd (HPSB) to provide full cooperation of handover and cease its management of Residensi Harmoni 2 (RH2) on 16th December 2021.

WE HEREBY ACKNOWLEDGE AND UNDERSTAND:

1. That the one-year contract term to manage Residensi Harmoni 2 by HPSB has ended w.e.f 30th September 2021.

2. By virtue of Section 21(2) of Strata Management Act 2013, JMB is empowered to employ or arrange and secure the services of any person or agent to undertake the maintenance and management of the common property. Therefore, we entrust the JMB to exercise their duties in ensuring the maintenance and management of Residensi Harmoni 2 and has not acted beyond its capacity of the resolution of the 1st AGM (26th September 2020) Agenda 5.6.

3. The appointment of the new managing agent (MA) and service providers by the JMB WILL NOT affect the current maintenance fee of RM0.15/sq ft.

4. The appointment of the new MA will encourage the independence and transparency of the management of Residensi Harmoni 2 from the developer in line with Section 87 Strata Management Act 2013.

5. To avoid conflict of interest taking into consideration that current MA is also act as the developer of RH2. This to ensure the MA able to deliver their duty as MA and provide better quality of service to the parcel owners.

6. To appoint independent and experience MA to manage the property and ensure the MA adhere with Strata Management Act that can be the guidance for the common practice.

This petition is for Residensi Harmoni 2 (RH2) owners in order to support on Joint Management Body (JMB) effort and decision to change the MA to manage the RH2 property. The JMB with the Petitioners request to change MA for RH2 property as for the constructive reasons and betterment of RH2.
