We, the undersigned homeowners of the Blueberry Lane community, formally express our dissatisfaction with the current property management company, J&M Management. Our grievances include, but are not limited to, the following issues:

  1. Unjust and Excessive Fines:
    • The management company has implemented aggressive enforcement of minor infractions, such as fines for "moss on roofs," without prior notice or transparency. This was not communicated when most of us purchased our homes.
    • Numerous instances of incorrect billing, including overcharges and unexplained fees, have not been rectified despite multiple requests.
    • A review of the 2021 Revised Community Rules reveals a stricter fine schedule and escalating penalties that were not present in the original 2016 CC&Rs. Homeowners were not properly notified of these changes, as required by RCW 64.90.525, and were not given the opportunity to vote on these amendments.
  2. Unreasonable Fines:
    • J&M Management has failed to uphold its responsibility for maintaining common areas, leading to visible deterioration and lack of timely repairs. Instead, they have placed the burden on individual homeowners for maintenance of areas that were previously managed by the HOA, as per the original 2016 CC&Rs.This shift in responsibility was not clearly communicated or agreed upon by homeowners, contributing to confusion and disputes over maintenance duties.
    • The management company has issued fines for minor and unreasonable infractions, such as "moss on roofs," which were not consistently communicated as violations when we purchased our homes.
    • Homeowners have faced fines without due process, with inadequate notice and lack of transparency in the enforcement process.
  3. Neglect of Common Areas:
    • J&M Management has failed to adequately maintain communal areas, including landscaping and repairs, despite these areas being adjacent to homeowner properties.
    • Lack of timely response to maintenance requests and visible deterioration of shared community spaces.
  4. Lack of Transparency and Communication:
    • Changes to the Covenants, Conditions, and Restrictions (CC&Rs) and Community Rules were made without proper notification or homeowner consent. The 2020 Amendment and subsequent rule changes in 2021 included additional restrictions and penalties that were not clearly disclosed to homeowners. These changes to the Covenants, Conditions, and Restrictions (CC&Rs) and Community Rules were implemented without proper notification to homeowners, leading to confusion and unfair enforcement practices.
    • Multiple requests for clarification or documentation have been ignored or met with conflicting responses.

Based on these issues, we, the homeowners, request the following actions from the Blueberry Lane HOA Board:

  1. Terminate Contract with J&M Management:
    • Exclude J&M Management from consideration during the next contract renewal process, given their poor performance, lack of transparency, and numerous homeowner complaints.
  2. Review and Eliminate Unjust Fines:
    • Conduct a review of all fines issued under the revised rules since 2021. Any fines based on changes not properly disclosed or ratified should be rescinded.
  3. Conduct a Transparent Review of Governing Documents:
    • Review the changes made to the CC&Rs and Community Rules in 2020 and 2021, ensuring that all modifications were done in accordance with legal requirements and with proper homeowner notification and voting procedures.
    • Provide homeowners with a clear and comprehensive summary of the current governing documents and any amendments made in recent years.

We urge the Board to take immediate action to address these concerns and restore trust in the management of our community.
