Re: Unauthorized Charges

We are all tenants of the Villages of Addison (formerly Alara Villages of Addison). We direct your attention to your email dated April 23, 2015, informing us of the following changes to our current lease agreements. The changes were to be implemented with our June 10th First Billing Services bill.

• Common Electric Charges Allocated between $10 to $14 per month
• Trash Charge $28.88 per month
• Valet Trash Charge $19.00 per month

These charges are in violation of our TAA Lease Agreements per below:

Texas Apartment Association Lease Agreements, signed by residents of Alara Villages of Addison, do not allow rent increases or lease contract changes before the initial lease contract term ends (Paragraph 15) unless they were added by a special provision in paragraph 10, by a written addendum or amendment sign by both parties of the lease. There were no such provisions in Paragraph 10 nor any written addendum or amendment which would have allow for these changes.

The Trash Collection Service Addendum is for “In-house” trash collection with no amount listed as a charge for this service. If there was an amount listed, then this amount cannot be changed until the lease term ends.

The allocation charge for Common Area Electric charges has no basis as we are billed directly from our electric provider for our own apartments. Please refer to The Public Utility Commission (PUC) rules under The Texas Administrative Code, Title 16, Part II.

We petition you to remove these charges form our First Billing Service accounts and adjust our records accordingly.
