At a time when the ceiling of freedoms is rising in the Arab world, five rights activists who demanded democratic reforms are being prosecuted. They are detained because the court has refused to release them on bail for nearly six months on charges of incitement and publicly insulting the President of the UAE and two senior state officials. They are being tried in a court whose rulings are not subject to appeal and possibly without sufficient due process. At some stages in the trial, the defendants have been isolated from their relatives and attorneys, and they are tried in secret sessions in which the defendants and their attorneys have not been able to access the entire case file, discuss evidence, or question prosecution witnesses. In addition, the court panel has been changed three times, and the court has disregarded the fact that the arrest and search procedures were illegal. The trial has been accompanied by a media campaign, joined by the official media, designed to smear the defendants and cast them as traitors, and they have received death threats that have not been seriously investigated by the authorities. During their detention, the defendants have been subjected to harsh treatment and inhumane detention conditions, and their defense counsel has been subjected to ongoing attempts by State Security to intimidate them. Letters have been sent to a member of the defense counsel threatening his life, and other attorneys have been threatened and pressured in their professional lives.

The defendants on trial include: Ahmad Mansour al-Shehhi, a writer, poet, and rights activists who joined other Emirati citizens this year is circulating an online petition directed at the rulers of the UAE asking for wholesale reforms of the parliamentary system and greater authority for the Federal National Council; Dr. Nasser Bin Ghaith al-Merri, a lecturer at the Sorbonne campus in Abu Dhabi, who published a letter criticizing what he described as an attempt by the authorities to avoid political reform by buying the silence of the public through generous government spending programs; citizen Fahd Salim al-Shehhi; citizen Hasan ‘Ali Al Khamis; and Ahmad ‘Abd al-Khaliq, who is stateless. They were arrested after making democratic demands and stating their opinions about public affairs online.

The treatment of the five defendants is in violation of several human rights declarations and agreements, which uphold freedom of opinion and expression, the right to freedom, and protection from arbitrary detention, as well as the right to a fair trial and the right of detainees to adequate treatment during detention. As a result of this, numerous international human rights organizations have issued statements condemning the treatment of the five activists and demanding the withdrawal of all charges against them.

As such, we call for the release of all prisoners of conscience in the UAE, first and foremost the five defendants in this case, and the withdrawal of all charges against them.

في الوقت الذي يرتفع فيه سقف الحريات في الوطن العربي، تجري محاكمة خمسة نشطاء حقوقيين طالبوا بإصلاحات ديمقراطية محتجزين بسبب رفض المحكمة اطلاق سراحهم مقابل كفالة منذ قرابة الستة أشهر بتهمة التحريض و "الإهانة العلنية" لرئيس دولة الإمارات العربية المتحدة واثنين من كبار مسؤولي الدولة، في محاكمة لا يسمح القانون باستئناف إحكامها، ويعتقد انه لا تنطبق عليها شروط العدالة بالشكل الكافي حيث تم ببعض مراحلها عزل المتهمين عن اقاربهم ومحاميهم ومحاكمتهم بجلسات سرية ولم يتم تمكين المتهمين والمحامين خلالها من الاطلاع على كامل ملف القضية ومناقشة الادلة واستجواب شهود الاثبات اضافة لتغيير هيئة المحكمة ثلاث مرات خلال المحاكمة وقد تجاهلت المحكمة اجراءات اعتقال والتفتيش جرت خارج اطار القانون. وترافقت المحاكمة مع حملة اعلامية قوية اشترك فيها الاعلام الرسمي تهدف الى تشويه سمعتهم وتخوينهم اضافة لتلقيهم اتهامات بالقتل لم تقم السلطات بالنظر فيها بجدية. كما تعرض المعتقلون خلال فترة اعتقالهم لمعاملة قاسية وظروف احتجاز غير إنسانية. وتعرضت هيئة الدفاع لمحاولات متواصلة من أجهزة أمن الدولة لترهيبها و ذلك بإرسال رسائل تهديد لأحد أعضاء الهيئة بتعريض حياته الشخصية للخطر أو تهديدهم  وممارسة الضغط عليهم في أعمالهم ومصدر رزقهم.

المتهمون الذين تجري محاكمتهم  هم أحمد منصور الشحي  وهو أديب و شاعر و ناشط حقوقي انضم الى غيره من مواطني الامارات هذا العام في رفع عريضة  بثت على شبكة الانترنت إلى حكام الإمارات تطالب بإصلاح كلي للنظام البرلماني وبمزيد من السلطات للمجلس الوطني الاتحادي والمعتقل الدكتور ناصر بن غيث المري وهو محاضر بفرع جامعة السوربون الفرنسية في أبوظبي ونشر مقالا انتقد فيه ما وصفه بمحاولة السلطات تجنب اجراء اصلاح سياسي من خلال شراء صمت الجماهير ببرامج انفاق حكومية سخية. والمواطن فهد سالم الشحي والمواطن حسن علي آل خميس  وأحمد عبدالخالق وهو عديم الجنسية تم اعتقالهم على اثر مطالباتهم بالديمقراطية وإدلائهم بآراء في الشأن العام عبر شبكة الانترنت.

وحيث ان ما يتعرض له المتهمون الخمسة مخالف للعديد من الإعلانات والاتفاقيات الخاصة بحقوق الانسان والتي تكفل حرية الرأي والتعبير والحق في الحرية والحماية من الاعتقال التعسفي، كما تكفل الحق بالحصول على محاكمة عادلة وحق المحتجز في ان يحصل على معاملة لائقة خلال فترة احتجازه، مما دعى العديد من منظمات حقوق الانسان الدولية لإصدار بيانات تستنكر فيها ما تعرض له النشطاء الخمسة وتطالب باسقاط التهم الموجهة ضدهم.
